Amazon Nectar – New Product from Amazon….nothing to do with Bees

Amazon Nectar Trademarks

Last week (but only spotted by me today) Amazon applied to register trademarks in The EU, US and UK for ‘Nectar’:

You might think this is for another one of their own label products, presumably Honey or some such.

You would be wrong.

In fact it has been applied for for the following services:

Provision of information relating to music; entertainment services, namely, providing playback of music in generated playlists via the internet and other communications networks; entertainment services, namely, a multimedia program series featuring music and musicians distributed via the internet and other communications networks.

Amazon does have a playlist for dance music on Amazon Music called Nectar, but it seems odd to me that they would just apply for this standalone trademark for that alone, particularly when there’s only 49 songs on the playlist. Also, they have only ever applied for one other trademark for a playlist in the EU, being ‘Level’ in December 2018. So (potentially) watch this space!

It will be interesting to see if this service ever arrives, or if trademark problems nix it from the get go. There are currently 107 trademarks registered in class 41 (the same class as this) which could cause a potential problem. Here’s just some of the more recent ones:

And finally, spare a thought for poor Phil Barton, who only 3 days after Amazon, filed an application for trademark registration with the UKIPO for ‘Nectar Records’ and is likely to now have quite teh trademark fight on his hands!

Solutionwear by Kimono – Kim Kardashian seeks Trademarks for Solutionwear, Kimono Solutionwear & Kimono World

What is it?

I don’t know. But it has something to do with Kim Kardashian and her upcoming lingerie line, Kimono.

Solutionwear Trademark Applications

There are six separate trademark applications, three in the US (filed in April) and three in the EU (two filed just this week):

Each trademark is filed for in three different trademark classes, and each is filed for the following goods:

Class 18 – Leather and imitation leather belts, luggage, bags, wallets, whips, harness, cosmetic bags, purses.
Class 25 – Lingerie, shapewear, baby doll, stockings, breast shapers, petals, pasties, bra inserts, bras, bralette, slips, teddy, romper, bodysuits, corsets, bustiers, camisoles, chemisoles, chemises, negligee, bikinis, brassiere, girdle, nightgown, nightie, leotard, socks, tees, t-shirts, sweatshirts, swimwear, swimwear accessories, headgear, shoes, namely, sandals.
Class 35 – Retail store services.

Obviously, the first obvious question is:

What are “breast shapers”?

The US trademarks have all already hit speedbumps with the US Patents Office, which has sought clarification of a number of queries in respect of each application. In fact, there’s no less than 46 pages of attachments to the USPTO’s objection for “Solutionwear”

My favourite issue though, it this one:

Further, applicant’s mark “KIMONO WORLD” includes the word “KIMONO,” which implies that applicant’s services deals with selling kimonos. However, if kimonos are not sold as part of applicant’s retail services, then registration may be refused because the mark consists of or includes deceptive matter in relation to the identified services. See 15 U.S.C. §1052(a); In re Budge Mfg. Co., 857 F.2d 773, 8 USPQ2d 1259 (Fed. Cir. 1988); TMEP §1203.02-.02(b).

To avoid such refusal, applicant may amend the identification to specify that it sells kimonos as part of its services. See TMEP §§1203.02(e)(ii), (f)(i), 1402.05 et seq.

Yes, Kim Kardashian’s trademark application for Kimono World is being refused because, you know, she doesn’t sell Kimonos. Bahahahaha.
