Solutionwear Trademark Applications

There are six separate trademark applications, three in the US (filed in April) and three in the EU (two filed just this week):

Each trademark is filed for in three different trademark classes, and each is filed for the following goods:

• Class 18 – Leather and imitation leather belts, luggage, bags, wallets, whips, harness, cosmetic bags, purses.
• Class 25 – Lingerie, shapewear, baby doll, stockings, breast shapers, petals, pasties, bra inserts, bras, bralette, slips, teddy, romper, bodysuits, corsets, bustiers, camisoles, chemisoles, chemises, negligee, bikinis, brassiere, girdle, nightgown, nightie, leotard, socks, tees, t-shirts, sweatshirts, swimwear, swimwear accessories, headgear, shoes, namely, sandals.
• Class 35 – Retail store services.

Obviously, the first obvious question is:

What are “breast shapers”?

The US trademarks have all already hit speedbumps with the US Patents Office, which has sought clarification of a number of queries in respect of each application.  In fact, there’s no less than 46 pages of attachments to the USPTO’s objection for “Solutionwear”

My favourite issue though, it this one:

Further, applicant’s mark “KIMONO WORLD” includes the word “KIMONO,” which implies that applicant’s services deals with selling kimonos.  However, if kimonos are not sold as part of applicant’s retail services, then registration may be refused because the mark consists of or includes deceptive matter in relation to the identified services.  See 15 U.S.C. §1052(a); In re Budge Mfg. Co., 857 F.2d 773, 8 USPQ2d 1259 (Fed. Cir. 1988); TMEP §1203.02-.02(b).

To avoid such refusal, applicant may amend the identification to specify that it sells kimonos as part of its services.  See TMEP §§1203.02(e)(ii), (f)(i), 1402.05 et seq. 

 

Yes, Kim Kardashian’s trademark application for Kimono World is being refused because, you know, she doesn’t sell Kimonos. Bahahahaha.
